Welcome to Gia Phát (giaphat.org). Please read these Terms of Use carefully before using our service. By accessing and using the platform, you agree to comply with and be bound by the terms below.

1. Definitions

In these Terms, the following terms are defined as follows:

• "Platform" means the Gia Phát digital family tree management system, including the website giaphat.org and related applications.
• "User" means any individual who registers, accesses or uses the Platform.
• "Service" means all features, tools and content provided by the Platform.
• "User Content" means all information, data, images and text uploaded or created by a User on the Platform.

2. Acceptance of Terms

By creating an account or using any feature of the Platform, you confirm that you have read, understood and agreed to these Terms of Use in their entirety.

If you do not agree with any of these terms, please stop using the Platform immediately. Continued use after the terms are updated means you accept those changes.

3. User Accounts

To use the full features of the Platform, you need to create an account. When creating an account, you agree to:

• Provide accurate, complete and up-to-date information.
• Keep your login credentials secure and not share your account with others.
• Be responsible for all activity that occurs under your account.
• Notify us immediately if you discover unauthorized access to your account.

4. Services Provided

Gia Phát provides a digital family tree management platform with the following key features:

• Building and managing a visual family tree with detailed member information.
• Tracking ancestors' death anniversaries with automatic lunar-solar calendar conversion.
• Sharing news, photos and important family events.
• Inviting and connecting family members to jointly build the family tree.

5. User Content

You retain full ownership of the User Content you create on the Platform, including family tree information, photos, posts and other personal data.

By uploading content, you grant Gia Phát a limited license to:

• Store, display and distribute content according to the privacy settings you choose.
• Create backups to ensure data safety.
• Improve and develop the Platform's features.
• You may delete your own content at any time using the management features on the Platform.

6. Content Policy: Zero Tolerance for Violating Content

Gia Phát applies a zero-tolerance policy toward violating content and abusive user behavior. By using community features (news feed, comments, photo sharing), you agree not to post:

• Content that insults, defames, expresses hatred, discriminates against, or harasses any individual or group.
• Sexual, provocative, violent, threatening content or content that encourages dangerous behavior.
• Content that impersonates others, violates privacy or discloses other people's personal information without permission.
• False information, fraud, spam or unauthorized advertising.

The Platform automatically scans for and blocks violating language as soon as you post or comment. In addition, every post and comment has options to Report, Hide and Block users so you can proactively remove unwanted content from your feed.

We receive and process all reports within 24 hours of receipt. Violating content will be removed, and violating accounts may be warned, temporarily suspended or permanently terminated without prior notice, depending on the severity.

7. User Responsibilities

When using the Platform, you agree not to:

• Post content that violates the law, or infringes on others' privacy or intellectual property rights.
• Use the Platform to spread false, misleading or fraudulent information.
• Attempt unauthorized access to the system, other accounts, or data you do not have access rights to.
• Use automated software, bots, or similar tools to access or collect data from the Platform.
• Negatively affect the performance, stability or security of the Platform.

8. Privacy and Data Security

We are committed to protecting your personal information and family tree data. The collection, storage and processing of data is carried out in accordance with our Privacy Policy.

Your family tree data is private property. We do not share, sell or provide your personal data to third parties except as specified in the Privacy Policy or when required by a competent legal authority.

9. Intellectual Property

All interfaces, source code, designs, logos, trademarks and other intellectual property on the Platform belong to Gia Phát or its licensors.

You may not copy, distribute, modify or create derivative works from any part of the Platform without our prior written consent.

10. Service Availability

We strive to ensure the Platform operates continuously and stably. However, we do not guarantee that the Service will be uninterrupted, error-free or always available.

We reserve the right to suspend or discontinue the Service for maintenance, upgrades or other technical reasons. We will try to give notice before any significant changes.

11. Limitation of Liability

To the extent permitted by law, Gia Phát is not liable for any indirect, incidental, special or consequential damages arising from the use or inability to use the Platform.

We are not responsible for the accuracy of content created by Users. You are solely responsible for verifying family tree information before using it.

12. Termination

You may stop using the Platform and request account deletion at any time. Once an account is deleted, related data will be handled in accordance with the Privacy Policy.

We reserve the right to suspend or terminate your account if we find a violation of these Terms, with notice where possible. In cases of serious violation, termination may take effect immediately.

13. Changes to the Terms

We reserve the right to update and revise these Terms of Use from time to time. Any changes will be announced via the Platform or your registered email.

Continued use of the Platform after the terms are updated means you accept the changes. If you do not agree, you have the right to stop using the Platform.
